Why are international student-athletes restricted from making money?

F-1 Visa legislation was written prior to the emergence of social media influencing, therefore international student-athletes participating in NIL was understandably not considered. There are many different restrictions at play, for very legitimate reasons, when international student-athletes are studying in the United States. One of the primary restrictions being that they may not take any off-campus employment. A select few go through careful scrutiny to accept limited off-campus internships that are required for their academic degree. There are other very nuanced exceptions beyond this, but the reality for most international student-athletes is that they are very restricted from making income while in the United States.

How is this different?

The work was performed while in The Bahamas so the restrictions surrounding active employment do not apply to the royalties distributed through the sale of the footage. 

How did we do it?

Influxer traveled to The Bahamas where multiple NCAA Division 1 basketball tournaments took place in November to facilitate production shoots with the purpose of capturing footage that can be sold throughout the duration of the players collegiate careers.

Does this include dual-citizenship?

Dual-citizen student-athletes do not have the same restrictions as International Student-Athletes and therefore, for this purpose, can normally participate in NIL. 

What are digital assets?

Digital assets are individual pieces of content available to purchase for use in or simply as a way to show your support to your favorite international student-athletes. 

What are promotional products? 

Purchase promotional products, like posters, are available to purchase as a way for family, friends, and fans to support their favorite player(s).

How are the players paid?

A percentage of sales from the individual international student-athlete’s collection of downloadable digital assets and promotional products will be distributed to them as passive income.
